Gideon's Trumpet: Book Review
[ send me this paper ]
12 pages in length. Gideon's Trumpet is an account of a precedent setting ruling that changed the landscape of the American legal system. False accusations and time spent in jail were the catalysts to Gideon's hell-bent journey through the unfriendly maze of a system whereby only certain American citizens are bestowed the luxury of legal council based upon their ability to pay for it. Gideon's quest to challenge this system proved quite fruitful for a man whose own unsavory background might present him as a rather interesting choice for championing such a cause. Nonetheless, the previous offender took the opportunity availed to him by a nation of freedom fighters to secure one more right that was being withheld by the highest court in the land: a constitutional entitlement to lawful representation by the state despite the inability to pay. Along the winding path of this judicial journey, readers find out just how inequitable the United States court system has long been and come to rally behind a convicted criminal who strives to alter the skewed system for not only his benefit but also all who come behind him without the ability to afford legal representation. Bibliography lists 3 sources.

Gideon’s Trumpet & Constitutional Law
[ send me this paper ]
A 5 page research paper that discusses Gideon’s Trumpet by Anthony Lewis, which is an expertly written, comprehensive account of a landmark case in constitutional law, Gideon v. Wainwright, which was heard by the U.S. Supreme Court in 1963. Clarence Earl Gideon was a prisoner in the Florida penal system who felt that his constitutional rights had been violated because his request for a court-appointed lawyer at this trial was denied. Lewis’ book tells how Gideon succeeded in taking his case before the Supreme Court and, in so doing, this text illustrates how—while there are flaws in the American system of jurisprudence—it works because it has mechanisms in place for correcting errors. Bibliography lists 3 sources.

Gitlow vs. New York
[ send me this paper ]
An 11 page paper arguing the validity of the Supreme Court decision of this case. Gitlow v. New York was decided in 1925 and is studied today as a classic case of the limits of the freedom of speech guaranteed under the First Amendment. New York tried and convicted Benjamin Gitlow on charges of criminal anarchy in two counts: one was for advocating the overthrow of the government; the other was for publishing a booklet doing the same. The reason for the continued interest in the case is not so much the issue of freedom of speech for the individual, but is studied more for the value of both the majority opinion and the dissenting view of Justices Holmes and Brandeis. Each side presents value in their arguments, but it appears from the perspective of 75 years later that the dissenting view is more reasonable than that of the majority. Bibliography lists 11 sources.
